2. Legal Framework
This policy is governed by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the General Data Protection Regulation, "GDPR"), as implemented in Luxembourg by the Act of 1 August 2018 on the organisation of the National Commission for Data Protection (CNPD) and the general data protection framework, and the amended Act of 30 May 2005 on data protection and electronic communications.

3. Data Collected and Purpose
Noctixal collects personal data only in the following circumstances:
Contact form submissions: name, email address, and the content of the message you provide. This data is used solely to respond to your project enquiry. Legal basis: Article 6(1)(b) GDPR — processing necessary for the performance of a contract or pre-contractual steps at your request.
Website analytics: noctixal.com uses Plausible Analytics, a cookieless and privacy-respecting analytics tool. Plausible does not use cookies, does not collect personal data, does not track individual users across sessions or devices, and is fully compliant with GDPR, the ePrivacy Directive, and the CNPD cookie guidelines of 26 October 2021. No consent banner is required for this tool. Aggregate traffic data is stored on servers within the EU.
Project delivery: if you engage Noctixal for a project, you may provide additional information (business name, requirements, content) necessary to complete the agreed scope. This data is processed on the legal basis of Article 6(1)(b) GDPR — contractual performance.
4. Data Retention
Contact form data is retained for no longer than 12 months from the date of submission, or for the duration of an active client relationship, whichever is longer. It is then permanently deleted. Analytics data collected via Plausible is aggregated and non-personal — it is not subject to deletion requests as it cannot be linked to any individual.
5. Data Sharing and Third Parties
Noctixal does not sell, rent, or share your personal data with any third party for commercial purposes. Data may be processed by the following sub-processors solely in the context of service delivery:
Plausible Analytics (plausible.io) — cookieless analytics, EU-hosted, GDPR-compliant by design.
Email infrastructure used to receive and respond to contact form submissions — no data is forwarded to marketing platforms.
No data is transferred outside the European Economic Area.
6. Your Rights Under GDPR
As a data subject under GDPR Articles 15–22, you have the following rights:
Right of access (Article 15): you may request a copy of the personal data held about you.
Right to rectification (Article 16): you may request correction of inaccurate data.
Right to erasure (Article 17): you may request deletion of your data where no legal obligation requires its retention.
Right to restriction of processing (Article 18): you may request that processing be limited in certain circumstances.
Right to data portability (Article 20): you may request your data in a structured, machine-readable format.
Right to object (Article 21): you may object to processing based on legitimate interests.
To exercise any of these rights, contact contact@noctixal.com. Requests will be addressed within 30 days in accordance with Article 12 GDPR. If you believe your rights have not been respected, you may lodge a complaint with the CNPD at cnpd.public.lu.
7. Intellectual Property and Website Ownership
All code, design, and content on noctixal.com is the property of Noctixal unless explicitly stated otherwise. For websites built and delivered to clients: upon receipt of full payment, the client receives full ownership of the delivered source code and all associated assets. Noctixal retains no claim over delivered work after handover. Client-provided content (logos, images, copy) remains the intellectual property of the client at all times.
8. Cookies
noctixal.com does not use cookies. The analytics tool in use (Plausible) operates without cookies and without collecting personal data. No cookie consent banner is required or displayed, in compliance with the CNPD guidelines of 26 October 2021.
9. Changes to This Policy
This policy may be updated to reflect changes in applicable law or in how Noctixal operates. The date at the top of this page reflects the most recent revision. Continued use of the website after a policy update constitutes acceptance of the revised terms.
